“Whenever he
appointed a man to lead a military detachment, the Messenger of Allah
(ﷺ) would advise him especially to fear Allah and treat the Muslims
with him well. He (ﷺ) said: ‘Fight in the Name of Allah and in
the
cause of Allah. Fight those how disbelieve in Allah. Fight but do
not
be treacherous, do not steal from the spoils of war, do not
mutilate
and do not kill children. When you meet your enemy from
among the
polytheists, call them to one of three things. Whichever of
them they
respond to, accept it from them and refrain from fighting
them. Invite
them to accept Islam, and if they respond then accept it
from them and
refrain from fighting them. Then invite them to leave
their land and
move to the land of the polytheists. Tell them that if
they do that,
then they will have the same rights and duties as the
polytheists. If
they refuse, then tell them that they will be like
the Muslim Bedouins
(who live in the desert), subject to the same
rulings of Allah as the
believers. But they will have no share of
Fay’* or war spoils, unless
they fight alongside the Muslims. If
they refuse to enter Islam, then
ask them to pay the Poll-tax. If
they do that, then accept it from
them and refrain from fighting
them. But if they refuse, then seek the
help of Allah against them
and fight them. If you lay siege to them
and they want you to give
them the protection of Allah and your
Prophet, do not give them the
protection of Allah and your Prophet,
rather give them your
protection and the protection of your father and
your Companions, for
if you violate your protection and the protection
of your fathers,
that is easier than violating the protection of Allah
and the
protection of His Messenger. If you lay siege to them and they
want
you to let them come out with a promise of the judgement of Allah
and
His Messenger (ﷺ), do not offer them a promise of the judgement
of
Allah and His Messenger (ﷺ), rather offer them your judgement,
because you do not know if you will actually pass (the same as)
Allah’s judgement regarding them or not.’”

Surely, the gates of Paradise are under the shadows of the swords. A man in a shabby condition got up and said; Abu Musa, did you hear the Messenger of Allah (ﷺ) say this? He said: Yes. (The narrator said): He returned to his friends and said: I greet you (a farewell greeting). Then he broke the sheath of his sword, threw it away, advanced with his (naked) sword towards the enemy and fought (them) with it until he was slain. - Hadith Muslim 1902 (islam)

That the Messenger of Allah (ﷺ) said: "There are six things with Allah for the martyr. He is forgiven with the first flow of blood (he suffers), he is shown his place in Paradise, he is protected from punishment in the grave, secured from the greatest terror, the crown of dignity is placed upon his head - and its gems are better than the world and what is in it - he is married to seventy two wives along Al-Huril-'Ayn of Paradise, and he may intercede for seventy of his close relatives."

A formal agreement of protection is made with citizens who are:
(1) Jews;
(2) Christians;
(3) Zoroastrians;
(4) Samarians and Sabians, if their religions do not respectively contradict the fundamental bases of Judaism and Christianity;
(5) and those who adhere to the religion of Abraham or one of the other prophets (upon whom be blessings and peace). - Fiqh Umdat as Salik o11.1 (islam)

Such an agreement may not be effected with those who are idol worshippers (dis:
o9.9(n:)), or those who do not have a Sacred Book or something that could have been a Book.
(A: Something that could have been a Book refers to those like the Zoroastrians, who have remnants resembling an ancient Book. As for the psuedoscriptures of cults that have appeared since Islam (n: such as the Sikhs, Baha'is, Mormons, Qadianis, etc.), they neither are nor could be a Book, since the Koran is the final revelation (dis: w4).) - Fiqh Umdat as Salik o11.2 (islam)

TRUCES (0: As for truces, the author does not mention them. In Sacred Law truce means a peace treaty with those hostile to Islam, involving a cessation of fighting for a specified period, whether for payment or something else. The scriptural basis for them includes such Koranic verses as:
(1) "An acquittal from Allah and His messenger..." (Koran 9:1);
(2) "If they incline towards peace, then incline towards it also" (Koran 8:61);
as well as the truce which the Prophet (Allah bless him and give him peace) made with Quraysh in the year of Hudaybiya, as related by Bukhari and Muslim.
Truces are permissible, not obligatory. The only one who may effect a truce is the Muslim ruler of a region (or his representative) with a segment of the non-Muslims of the region, or the caliph (025) (or his representative). When made with other than a portion of the non-Muslims, or when made with all of them, or with all in a particular region such as India or Asia Minor, then only the caliph (or his representative) may effect it, for it is a matter of the gravest consequence because it entails the nonperformance of jihad, whether globally or in a given locality, and our interests must be looked after therein, which is why it is best left to the caliph under any circumstances, or to someone he delegates to see to the interests of the various regions.
There must be some interest served in making a truce other than mere preservation of the status quo. Allah Most High says, "So do not be fainthearted and call for peace, when it is you who are the uppermost" (Koran 47:35).
Interests that justify making a truce are such things as Muslim weakness because of lack of numbers or materiel, or the hope of an enemy becoming Muslim, for the Prophet (Allah bless him and give him peace) made a truce in the year Mecca was liberated with Safwan ibn Umayya for four months in hope that he would become Muslim, and he entered Islam before its time was up.
If the Muslims are weak, a truce may be made for ten years if necessary, for the Prophet (Allah bless him and give him peace) made a truce with Quraysh for that long, as is related by Abu Dawud. It is not permissible to stipulate longer than that, save by means of new truces, each of which does not exceed ten years.
The rulings of such a truce are inferable from those of the non-Muslim poll tax (def: 011);
namely, that when a valid truce has been effected, no harm may be done to non-Muslims until it expires.) - Fiqh Umdat as Salik o9.16 (islam)

THE OBJECTIVES OF JIHAD Thc caliph (025) makes war upon Jews, Christians, and Zoroastrians (N: provided he has first invited them to enter Islam in faith and practice, and if they will not, then invited them to enter the social order of Islam by paying the nonMuslim poll tax (jizya, def: 01 L4)-which is the significance of their paying it, not the money itself-while remaining in their ancestral religions) (0: and the war continues) until they become Muslim or else pay the non-Muslim poll tax (0: in accordance with the word of Allah Most High, "Fight those who do not believe in Allah and the Last Day and who forbid not what Allah and His messenger have forbidden-who do not practice the religion of truth, being of those who have been given the Book-until they pay the poll tax out of hand and are humbled" (Koran 9:29), the time and place for which is before the final descent of Jesus (upon whom be peace). After his final coming, nothing but Islam will be accepted from them. for taking the poll tax is only effective until Jesus' descent (upon him and our Prophet be peace), which is the divinely revealed law of Muhammad, The coming of Jesus does not entail a separate divinely revealed law, for he will rule by the law of Muhammad, As for the Prophet's saying (Allah bless him and give him peace), "I am the last, there will be no prophet after me," this does not contradict the final coming of Jesus (upon whom be peace), since he will not rule according to the Evangel, but as a follower of our Prophet (Allah bless him and give him peace)). - Fiqh Umdat as Salik o9.8 (islam)

And kill them wherever you overtake them and expel them from wherever they have expelled you, and fitnah is worse than killing. And do not fight them at al-Masjid al- Haram until they fight you there. But if they fight you, then kill them. Such is the recompense of the disbelievers. - Quran Al-Baqarah(The Cow) 2:191 (islam)

[Remember] when your Lord inspired to the angels, "I am with you, so strengthen those who have believed. I will cast terror into the hearts of those who disbelieved, so strike [them] upon the necks and strike from them every fingertip." - Quran Al-Anfal(The Spoils of War) 8:12 (islam)

And fight them until there is no fitnah and [until] the religion, all of it, is for Allah. And if they cease - then indeed, Allah is Seeing of what they do. - Quran Al-Anfal(The Spoils of War) 8:39 (islam)

And when the sacred months have passed, then kill the polytheists wherever you find them and capture them and besiege them and sit in wait for them at every place of ambush. But if they should repent, establish prayer, and give zakah, let them [go] on their way. Indeed, Allah is Forgiving and Merciful. - Quran At-Tawbah(The Repentance) 9:5 (islam)

Fight them; Allah will punish them by your hands and will disgrace them and give you victory over them and satisfy the breasts of a believing people - Quran At-Tawbah(The Repentance) 9:14 (islam)

I have been commanded to fight against people so long as they do not declare that there is no god but Allah, and he who professed it was guaranteed the protection of his property and life on my behalf except for the right affairs rest with Allah. - Hadith Muslim 21a (islam)

On the day of the conquest of Mecca, the Prophet (ﷺ) said, "There is no more emigration (from Mecca)
but Jihad and intentions, and whenever you are called for Jihad, you should go immediately. No
doubt, Allah has made this place (Mecca) a sanctuary since the creation of the heavens and the earth
and will remain a sanctuary till the Day of Resurrection as Allah has ordained its sanctity. Fighting
was not permissible in it for anyone before me, and even for me it was allowed only for a portion of a
day. So, it is a sanctuary with Allah's sanctity till the Day of Resurrection. Its thorns should not be
uprooted and its game should not be chased; and its luqata (fallen things) should not be picked up
except by one who would announce that publicly, and its vegetation (grass etc.) should not be cut."
Al-`Abbas said, "O Allah's Messenger (ﷺ)! Except Al-Idhkhir, (for it is used by their blacksmiths and for
their domestic purposes)." So, the Prophet (ﷺ) said, "Except Al-Idhkhir." - Hadith Al Bukhari 1834 (islam)

And strive for Allah with the striving due to Him. He has chosen you and has not placed upon you in the religion any difficulty. [It is] the religion of your father, Abraham. Allah named you "Muslims" before [in former scriptures] and in this [revelation] that the Messenger may be a witness over you and you may be witnesses over the people.
